“You don’t have the right to hear the case.”Justice Abhijit  Gangopadhyay got  slams by Supreme Court over his telephonic interview related to a pending case

Abhijit Ray, Kolkata : Judges cannot give media interviews about pending cases if its in his  courtroom. Chief Justice of India (CJI) D Y Chandrachud on Monday took a dig at Calcutta High Court Judge Abhijit Gangopadhyay in a case filed by Trinamool Congress general secretary Abhishek Banerjee.At the same time, he observed that the judge does not have the right to hear the case if he comments outside the case in the courtroom. In that case, the Chief Justice of the Calcutta High Court will constitute another bench for that case. A bench of Chief Justice D Y Chandrachud and Justice P S Narasimha sought a more clarity on justice Gangopadhyay’s TV interview. Therefore, they have sought the seal of the Calcutta High Court on the report published in the paper or the statement of the petitioner’s lawyer Abhishek Manu Singhvi. A bench headed by the Chief Justice directed the Registrar of the High Court to personally talk to Justice Gangopadhyay whether he had given any interview or why he gave it. The statement has to be submitted to the Supreme Court in the form of an affidavit by Friday. The apex court also said it cannot summon Abhishek Banerjee till the next date of hearing on April 28.The apex court’s order in this regard on April 17 will continue. Apart from Manu Singhvi, Abhishek was represented in the Supreme Court by Ainji Parthasarathy Deb Barman. Cbi AInji S V Raju and the defendant’s lawyer Bikash Ranjan Bhattacharya, however, sought that the probe into the recruitment scam should not be stopped in the wake of the case. “We are not interfering in the investigation,” the chief justice of the apex court said. It’s going to go on and on. Incidentally, Justice Ganguly recently made some comments on a Bengali electronic channel, which has created a controversy.Justice Gangopadhyay also directed that the CBI can summon Abhishek Banerjee for questioning if required in a corruption case. The TMC national general secretary has moved the Supreme Court challenging the order. During the hearing, Singhvi said, “My client’s name is not anywhere in the High Court case. So how can Justice Abhijit Gangopadhyay of the High Court pass such an order?”On September 19, 2022, an English translation of what Justice Gangopadhyay had said in a TV interview was also submitted to the Supreme Court. On the basis of this, such a strong observation is made by the bench headed by the Chief Justice. Abhishek, who declined to comment directly after learning about the Supreme Court’s observations, said, “I have full faith in the judicial system. The Prime Minister, the Chief Minister, the Governor, the MLAs – no one is above the law. The law is above all. Everyone has to accept that. ’
