Sheikh Shahjahan Suspended from TMC & arrested by the Bengal Police in Sandeshkhali case -imposed several nonbailable sections

Kolkata:Shahjahan Sheikh was finally arrested.But can he be “caged”? The question arises.The ED feared that if the state police arrested him, they would file a lesser section case.

It is seen that the police have registered a case against the ‘Criminal King’ of Sandeshkhali under 11 sections.

However,there is a non-bailable clause in it.But there is no rape or gang rape.There are serious allegations such as human trafficking and prostitution.

Under what other sections have the case been registered? Minakhan police filed a case against Sheikh Shahjahan under several non-bailable sections including IPC 147, 148, 149, 341, 186, 353, 323, 427, 370, 506, 34 and sent him to the Basirhat sub-divisional court.

The police had sought 14-day police custody but the court remanded him to 10-day police custody. Under Section 147 of the Indian Penal Code, anyone found guilty of promoting a disturbance is punishable with fine or imprisonment for two years, or with imprisonment and fine.

According to Section 148 of the Indian Penal Code, possession of a sharp weapon or any sharp object which can be used as a weapon,with which a person can be killed.

If convicted, he could be fined for up to three years. Section 307 of the Indian Penal Code (IPC) carries a maximum jail term of seven years if convicted of attempt to murder.

According to Section 149 of the Indian Penal Code, intentionally being part of an illegal assembly.

Under Section 341 of the Indian Penal Code, anyone found guilty of unlawful obstruction is punishable with imprisonment of up to one month and a fine of Rs 500.

According to Section 186 of the Indian Penal Code, obstructing a public servant from discharging his duty is punishable with imprisonment for a maximum of three months and a fine of Rs.500.

According to Section 353 of the Indian Penal Code, a person wrongfully detains a person for a period of three days or more shall be punished with imprisonment for a term which may extend to two years,or with fine,or with both.

According to Section 323 of the Indian Penal Code, causing hurt intentionally will be punished with imprisonment which may extend to one year or with fine which may extend to Rs.1,000 or with both.

According to Section 427 of the Indian Penal Code, causing damage to the amount of fifty rupees or more will be punishable with imprisonment which may extend to two years or with fine or with both.

Section 370 of the Indian Penal Code deals with trafficking and forcible prostitution of minors.If convicted,the maximum penalty is seven years in prison.

According to Section 506 of the Indian Penal Code,if found guilty, the punishment for intimidation is two years in jail and a fine.

According to Section 34 of the Indian Penal Code, Sheikh Shahjahan can be convicted for criminal acts. In between, Sheikh Shahjahan suspended from Trinamool Congress for 6 years after arrest.
