Staff of the Pulakeshinagar police station are in the dock for harassing a 49-year-old woman along with her three children with special needs,detaining them at the station for several hours for questioning while tracking an accused in a kidnapping case, with whom she had a live-in-relationship .
The Victim has filed a writ petition with the court seeking legal action and also filed a complaint with the human rights commission,which taken cognisance and initiated inquiry into the matter .
According to the complaint,the police,which tracking down accused identified as Daniel Essex involved in a kidnap case in August last year,arrested and later jumped bail condition.
The police while searching for him on August 16,barged into the house of the victim,escorted her to the station and detained her for several hours to question.
The police also detained her three children,aged 16,14 and 12 who are specially abled and seized their phones and harassed them to know about his whereabouts.The accused was later arrested on Thursday and remanded to judicial custody .
Taking cognisance,the victim approached the court and filed a writ petition stating that even though she is not accused in any crime,she was kept at the station along with her children and harassed amount to human rights violations and illegal detention.
Detaining minor children and seizing their phones amounts to child right violation.One among the three children is a girl aged 14,suffering from epileptic seizure .
Due to the police highhandedness has aggravated her medical condition endangering her health and safety .
The illegal action of the police amounts to kidnapping and abduction under the provision of BNS and the concerned police officials are liable.
The police entered the house broke open the gates and ransacked the house to search for the accused which is also amounts to intrusion of privacy and violation of rights to privacy, she said in her submission in the writ petition filed in the high court.
Even though the government advocate made a submission and assured that the victims and her children will not be harassed ,the court asked the police officials concerned to file affidavit in response .
The victim now demanded the court to issue necessary direction to file an FIR against the police officials and ensure safety and security of the victim.
