Complaint filed against RSS general secretary Hosabale over Preamble remarks

Taking a strong exception on RSS General Secretary Dattatreya Hosabale’s comment against constitution preamble,the Karnataka unit of the Indian Youth Congress (IYC) Legal Cell,filed a complaint with the Seshadripuram police seeking legal action.

The complainant,Sridhara MM,State president Youth congress,legal cell,said that the accused Hosabale’s recently made a remark during a public function to “reconsider and remove”the terms “socialist” and “secular” from the Preamble is an“attack on the constitutional ethos”and“incitement against the nation’s founding values”.

Hosabale made these remarks on June 26,while addressing an event marking the 50th anniversary of the Emergency.

He claimed that the terms were not part of Dr.B R Ambedkar’s original Constitution and were forcibly inserted during the Emergency through the 42nd Constitutional Amendment Act of 1976.

These remarks made at a politically sensitive event by a high ranking ideologue of an organization are not just ideational commentary.They are deliberate, provocative and dangerous.Such remarks must not be taken lighlty.

They are not protected political speech,but rather and incitement to constitutional subversion and fall within the purview of cognizable crime offences .

The IYC complaint demanded legal action,accusing him of making “unconstitutional,inflammatory,and divisive” comments.

Police have acknowledged receipt of the complaint and said the matter is under legal review.

Similar complaint has been filed on Saturday by the KPCC member with the High grounds police station, seeking legal action.
